Alabama are suing their drummer, Mark Herndon, for more than 200-thousand dollars, saying he was overpaid for merchandise sales from their 2003 farewell tour. The Associated Press reports that in a lawsuit filed last month, the group claims that Mark was paid his share before the final accounting was done and that after all the sales were tallied, there were "no net merchandise revenues as defined by the contract." The group is also trying to withhold Mark\'s 65-thousand-dollar share of an advance on the band\'s Last Stand C-D -- which is being sold at Cracker Barrel restaurants -- until the merchandise overpayment is repaid. Alabama\'s attorney was not available for comment. |
